General Terms and Conditions

1. Scope

These General Terms and Conditions apply to all orders placed by consumers within the meaning of Section 13 of the German Civil Code (BGB) through our online shop.

The contracting party is the company identified in our Legal Notice.

Any differing or conflicting terms of the customer do not apply unless we have expressly agreed to their validity in writing.

Our offering is directed at customers within the European Union (EU) and, where offered in the online shop, the European Economic Area (EEA).

The version of these terms valid at the time of ordering governs the conclusion of the contract.

2. Contracting party

The purchase contract is concluded with:

[Company name] UG (limited liability)

[Street and house number]

[Postcode, town/city]

Germany

Commercial register: [Register court and registration number]

VAT identification number: [VAT ID]

Email: [Email address]

Our website's Legal Notice provides the authoritative contact details and further company information.

3. Conclusion of the contract

The presentation of products in our online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.

By clicking Buy now, Order with obligation to pay or an equivalently labelled button, you submit a binding offer to conclude a purchase contract for the goods in your basket.

After receipt of your order, you first receive an automatically generated email acknowledging its receipt. This acknowledgement does not yet constitute acceptance of your offer.

The purchase contract is concluded only when we expressly accept your order through an order acceptance confirmation or dispatch the ordered goods to you.

We reserve the right to reject orders where there is an objective reason, particularly obvious pricing or product errors, unavailable goods, suspected abusive or fraudulent orders, or statutory provisions that prevent performance of the contract.

We retain the contract text in accordance with statutory provisions. After you complete your order, you receive the order details and these General Terms and Conditions by email. If you have created a customer account, you can view your orders there at any time.

4. Product presentation

We strive to present our products as realistically as possible in the online shop.

Illustrations, product photographs, graphics, videos and other depictions serve to illustrate our products. Different screen and device settings can cause minor differences in colours, brightness, contrast and the appearance of materials compared with the actual product.

Dimensions, weights or other technical details given for individual products are approximate unless expressly stated otherwise. We reserve customary and technically unavoidable deviations within reasonable limits.

Computer-generated images or images created or edited with artificial intelligence (AI) on our website serve solely to present and illustrate our products. Only the relevant product description determines what is supplied and the product's characteristics.

Statutory warranty rights remain unaffected by the above provisions.

Unless expressly stated otherwise, our products are fashion jewellery. Material, colour and surface properties, as well as gold plating or coatings, are described in the relevant product description.

5. Contract language

The language available for concluding the contract is determined by the relevant language version of our online shop.

Where our online shop is offered in several languages, translations serve solely to improve understanding. In the event of contradictions, questions of interpretation or discrepancies between language versions, the German version prevails unless mandatory statutory provisions require otherwise.

Communications concerning your order generally take place in the language in which you completed the ordering process, where technically and organisationally possible.

6. Prices and payment terms

All prices in the online shop are final prices and include applicable statutory VAT where payable. Any shipping costs, customs duties, import charges or other additional costs payable by the customer are listed separately during the ordering process.

Customers can use the payment methods offered in the online shop during the ordering process. These may include Shopify Payments, PayPal, Klarna, Stripe or other payment providers displayed at checkout.

The selected payment method is charged in accordance with the respective payment provider's terms. We have no influence on the method or timing of that charge.

Refunds are generally made using the same payment method used for the original payment, unless a statutory obligation or a different agreement requires otherwise.

We reserve the right to restrict or exclude individual payment methods in particular cases, for certain delivery countries or order values, or following a fraud or risk assessment, where there is an objective reason.

If a customer is in default of payment, statutory provisions apply.

7. Delivery and shipping

Goods are delivered to the addresses specified during the ordering process within the countries we serve. Available delivery countries are shown in our online shop.

Delivery times are given for individual products or during the ordering process. All delivery times are estimates unless a binding delivery date has been expressly agreed.

If circumstances beyond our responsibility, particularly force majeure, official measures, industrial disputes, unforeseen transport or logistics disruptions or similar events, cause delivery delays, delivery periods are extended for the duration of the obstruction. We will inform you promptly of significant delays.

If an ordered product is permanently unavailable, we reserve the right to withdraw from the contract. Any payments already made will then be refunded promptly using the original payment method.

For deliveries to consumers, the risk of accidental loss or deterioration of goods passes only when the goods are handed over to you or a person authorised by you to receive them.

Partial deliveries are permitted where reasonable for you and where they do not cause additional shipping costs.

8. Retention of title

Delivered goods remain our property until the purchase price has been paid in full.

Pledging, transferring as security or otherwise disposing of goods subject to retention of title is permitted only insofar as legally permissible and provided our rights are not impaired.

Mandatory statutory provisions, particularly consumers' rights, remain unaffected.

9. Right of withdrawal

Consumers generally have a statutory right of withdrawal for distance contracts.

Details of the requirements, periods, exercise of that right and statutory exceptions are set out in our separate withdrawal policy, including the model withdrawal form, available on our website and forming part of the pre-contractual information.

10. Warranty

Statutory warranty rights apply.

If delivered goods have a defect when risk passes, you have the statutory rights under applicable provisions. These include the right to supplementary performance and, where statutory requirements are met, a reduction in price, withdrawal from the contract and, where applicable, damages.

The warranty excludes defects attributable to improper use, normal wear, lack of care, improper storage, unauthorised modifications or external influences after risk has passed, provided we are not responsible for them.

Normal signs of wear and changes to gold plating or coatings resulting from normal use, improper handling or contact with water, perfume, cosmetics, cleaning agents or other chemicals do not constitute a defect unless a material or manufacturing defect exists.

Any manufacturer guarantees apply independently of statutory warranty rights and do not restrict them.

11. Liability

We are liable without limitation for damage resulting from intentional or grossly negligent breaches of duty by us, our legal representatives or persons acting on our behalf.

For slightly negligent breaches of essential contractual obligations, we are liable only for foreseeable damage typical of the contract. Essential obligations are those whose fulfilment enables proper performance of the contract and on whose observance you may regularly rely.

Otherwise, liability for damage caused by slight negligence is excluded.

The above limitations do not apply to injury to life, body or health, claims under the German Product Liability Act, fraudulent concealment of a defect, assumption of a guarantee, or liability that is mandatory by law.

The above liability provisions apply correspondingly for the benefit of our legal representatives, employees and persons acting on our behalf.

12. Vouchers and promotional codes

If we offer vouchers, gift vouchers or promotional codes, the following additional provisions apply.

Vouchers and promotional codes may be limited by time, region, products, product categories or order values. Details are set out in the relevant participation conditions or promotion description.

Unless expressly stated otherwise, promotional codes cannot be applied retrospectively to completed orders, paid out or combined with other discount promotions.

Promotional codes cannot be redeemed for cash. Gift vouchers may be redeemed only under the applicable terms.

We reserve the right to block vouchers or promotional codes or refuse their redemption where there is an objective reason to suspect abuse, manipulation or other unauthorised use.

Customers' statutory claims remain unaffected by these provisions.

13. Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer habitually resident in another EU or EEA member state, the mandatory consumer protection provisions of your country of residence remain unaffected by this choice of law.

14. Consumer dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

Consumers' statutory rights, particularly the right to apply to the competent courts or other bodies provided for by law, remain unaffected.

15. Final provisions

If individual provisions of these General Terms and Conditions are or become wholly or partly invalid or unenforceable, the validity of the remaining provisions remains unaffected.

Statutory provisions replace the invalid or unenforceable provision. The same applies if these terms contain an unintended omission.
